1. An Agreement exists with you (Rightful owner or his representative)
1a. “You” and Leja villas t/as villas-to-rent-in-spain.com from registered office c/o 43 Plaza Sierra Castilla, La Marina Urb, 03177 San Fulgencio, Alicante, Spain hereby known as “Us”, “We” & “vtris.com”
1b, and villas-to-rent-in-spain.com. Hereby known as vtris.com where you give consent to vtris.com to act as non-exclusive agent to provide a facility where you can offer private accommodation for holiday lettings. This facility allows vtris.com to accept, to confirm, to amend, and to cancel bookings on your behalf and to receive and confirm payments.
2 PAYMENTS
2a. We advise that vtris.com will hold on trust all payments made by customers in cash, credit cards, bank transfers and cheques at all times throughout the duration of agreement and maintain these funds in an account with a recognised banking authority in England.
2b.You will be informed by vtris.com immediately any payment or future payment made on your behalf.
2c. Unless previously arranged by you, all money collected by vtris.com from customers and owed to you will only be available by vtris.com after the customers have completed their stay at the accommodation.
2d. Unless particular arrangements have been made previously to release these funds early this will be normal procedure in all future bookings.
3. COMMISSION
3a. You agree to pay vtris.com a commission of 10% of the full rental price of the booking.
3b. You agree that vtris.com can deduct at source the 10% commission from any funds being held on your behalf by vtris.com
3c. You agree that vtris.com is entitled to the commission when a booking is made or commences or when the deposit for booking is paid by the customer.
4. HOUSE INSURANCE / LIABILITY
4a. You shall at all times maintain a comprehensive insurance policy
4b. All customers who make a booking for the accommodation shall have a direct contact with you and you shall accept liability for that contract as principal.
4c. It is understood that vtris.com shall not be liable to you or any customer for any loss or damage whatsoever or howsoever caused arising directly or indirectly in connection with this agreement or booking.
4d. Without prejudice to the above you also agree to indemnify vtris.com from and against any liability, damages, losses, claims in regard to matters however they be described as Fair wear and tear
4e. You accept that small or negligible breakages/losses will occur.
5 ACCOMMODATION
5a. The accommodation will at all times remain of a good and clean standard in full working order and safe for occupation and use
5b.The accommodation will be provided with all due skill, care and diligence and that all persons provided or used by you (whether or not employed by you) In connection with the provision of the accommodation will be appropriately qualified, experienced and capable of competently performing the work or jobs for which they are provided
5c.The accommodation complies and will at all times comply in full with all applicable national, local trade and other laws, regulations and codes of practise including EU legislation where applicable relating to hygiene, fire, safety and other standards for those using the accommodation and that you have and will at all times maintain in force the appropriate current certificates confirming such compliance.
5d.You hold and will at all times maintain all required licences, consents and permissions required by applicable national and/or local law in relation to the accommodation.
5e.You confirm that you own the accommodation and/or have full and unrestricted power to enter into this agreement unless otherwise agreed with VTRIS
6 LOCAL AGENT / KEY HOLDER
6a. It is essential that you have a local agent or key holder to the accommodation and that person becomes known to the customer.
6b. It essential that that person agrees to meet and greet customers on their arrival at the accommodation and makes the key of entry available.
6c. It is essential that your local agent / key holder responds promptly to any queries or questions from the customer regarding the accommodation.
7 AMENDMENTS
7a. We, vtris.com may modify any of the afore mentioned terms and conditions at any reasonable time and using due consideration may post these possible modifications on web site.
8 TERMINATION
8a. You may terminate this agreement at any time after reasonable arrangements have been made with vtrisa.com
8b. For bookings where the customer has not yet stayed at accommodation but the deposit has already been paid, the money will be paid over to you by vtris.com on the understanding that you will honour the booking and then be responsible for obtaining all outstanding money due for the accommodation.
8c. All photos and details of accommodation will be cancelled from web site at your request and no further responsibility or liability for bookings will be held against either party.
